Your deadlines

The clock starts on the day of your collision

Ontario sets hard time limits on accident claims. Miss one and you can lose the right to recover anything at all. Here is what runs from the moment of the crash.

  1. Day 0

    The collision

Contact emergency assistance and undergo a medical evaluation. Collect names, insurance details, plate numbers and witness contacts — photographs are the fastest way.

  2. Day 14

    Accident benefits begin

Anyone entitled to accident benefits starts receiving them from the 14th day after the accident date, under the Statutory Accident Benefits Schedule.

  3. Day 120

    Notice to the at-fault driver

You have 120 days to notify the at-fault driver of your intention to sue. Waiting too long to notify could prevent you from recovering any compensation.

  4. 2 years

    Deadline to file a lawsuit

You have only two years to file. Given these time requirements, it is imperative to contact an accident attorney and begin your claim as soon as possible.

These are general timelines under Ontario law, not legal advice. The limits that apply to your claim depend on your circumstances — call 416-913-0055 and an ALG associate will walk you through yours at no cost.

Accident attorney at Accident Law Group reviewing a car accident claim

With over 35,000 motor vehicle collisions occurring per year in Ontario, it is evident that travel by car — so often taken for granted — is subject to real dangers that cannot be ignored. An alarming number of people, both drivers and passengers, suffer severe harm and even fatal injuries in accidents caused by the reckless or negligent behaviour of others.

Injury victims must be promptly informed of their rights and their ability to recover compensation: that is where we come in. ALG is connected to experienced, professional and compassionate accident and personal injury lawyers who work hard to evaluate all aspects of your claim and ensure that you recover as much compensation as possible.

The party interested in filing a claim has 120 days to notify the at-fault driver of their intention to sue, and only two years to file a lawsuit. Waiting too long to notify or file a claim could prevent you from being able to recover any compensation.

In the first hours

What to do immediately after a motor vehicle collision

The aftermath of a car accident is often riddled with trauma and chaos. Amidst all this, there are several steps you must take to protect yourself in terms of legal issues and claims.

  1. Call for help and get checked over

Immediately contact emergency assistance and undergo a medical evaluation. Take note of readily apparent injuries — but remember that many critical injuries do not show up straight away. Brain injury symptoms, for instance, may not be apparent until days or even weeks after the accident.

  2. Keep monitoring your condition

It is essential for injury victims to monitor their medical conditions and report any physical changes. What feels manageable on the day of the crash can turn out to be significant weeks later.

  3. Collect everything you can at the scene

Gather contact information for all people involved, vehicle insurance information, licence plate numbers and the contact details of any witnesses on the scene. One of the most effective ways to collect this is to take pictures you can then provide to your lawyer.

  4. Retain the right accident lawyer

Vehicle accidents are traumatic and overwhelming. ALG immediately puts you in touch with the expert accident injury lawyer who has the legal knowledge and skills to review the circumstances of the accident and identify fault on the part of other parties.

Do not wait

Do not wait long and jeopardise your ability to recover compensation. Give us a call as soon as possible at 416-913-0055.

How a claim breaks down

Every accident consists of three parts

Knowing which part your claim falls under decides who should be handling it — a licensed paralegal or an accident injury lawyer. At ALG you get the right one from the start.

Part 01

Property claim

Covers the damage to the vehicle that was involved in the accident.

Part 02

Accident benefits

Every person who meets with an accident is entitled to certain benefits — income replacement benefit, caregiver benefit, non-earner benefit and others. These are collectively termed accident benefits.

Part 03

Tort — suing between the parties

In the event of catastrophic impairments the role of an accident injury lawyer becomes significantly important, because this part of the representation lies beyond the jurisdiction of paralegals.

Your rights, your insurer, and the question of fault

A personal injury lawyer protects your rights

Most injury victims will not only be confronted with immediate pain and trauma from a car accident, but will also have to cope with consequential difficulties: loss of income for time taken off work, severe injuries affecting day-to-day living, and any long-term disabilities resulting from the accident.

The physical, emotional and financial grief resulting from a car accident should prompt you to retain an experienced lawyer immediately. ALG has an excellent reputation for helping accident clients through its recommended lawyers and paralegals, who unfalteringly fight for the rights of injury victims.

Motor vehicle collisions and insurance

Dealing with insurance claims is one of the most complicated aspects of a road accident. The process is lengthy, complex, and can easily overwhelm someone trying to handle it alone while simultaneously coping with their injuries.

Here, qualified and experienced legal representation is indispensable. The lawyers at ALG guide you through this complicated process and advocate on your behalf, so that you can focus on the medical treatment you need.

Motor vehicle collisions and liability concerns

If the accident resulted from the negligence or recklessness of the other driver, you may be able to hold that driver responsible for the injuries you suffered. In certain circumstances, liability may extend further — for instance if parts of the car were defective.

Liability issues can be detailed and technical. An experienced lawyer can help you determine the relevant liability issues so that you accurately evaluate the strength of your claim.

Quick advice from the accident scene

Accident victims tell us that a typical accident leaves the driver nervous and frightened, and that most of the time drivers are unable to concentrate on what to do right at the scene.

Highway Traffic Act

A personal injury lawyer fights your accident charges

In accidents, one or the other driver is commonly blamed and charged under the Highway Traffic Act. These charges range from Part One Provincial Offences to Part Three Provincial Offences, which carry serious consequences. The person facing these charges needs qualified legal representation.

ALG professionals have been successfully fighting these charges for the last 24 years. We help you in the proper determination of your fault and advise you accordingly.

This matters more than people realise

Sometimes you may not be at fault, but you may have admitted fault in ignorance or in the confusion of the accident scene. Contact ALG, narrate every single fact, and the fault can be accurately determined.
